Villa SoleLuna Sicily — Terms & Conditions

A reservation constitutes a binding agreement between the Guest and Villa SoleLuna once the required deposit has been received and the booking has been confirmed in writing.

The person making the reservation must be at least 18 years of age and is responsible for providing accurate information and for ensuring that all members of the party comply with these Terms & Conditions.

The booking is made for the number of guests stated in the reservation. Any change to the number of guests must be communicated to Villa SoleLuna in advance and may be subject to additional charges or approval.

A 30% deposit of the total accommodation price is required to confirm a reservation.

The remaining 70% balance is due 60 days before the scheduled arrival date.

If the reservation is made within 60 days of arrival, the full amount is payable at the time of booking.

A reservation is not considered confirmed until the required payment has been received and written confirmation has been issued.

If the balance is not received by the due date, Villa SoleLuna reserves the right to treat the reservation as cancelled by the Guest, subject to the applicable cancellation terms.

All prices are quoted in Euro (€) unless otherwise stated.

The price applicable to a confirmed reservation is the price communicated at the time of booking.

Any mandatory local taxes, tourist taxes, cleaning fees, additional guest charges or other applicable charges will be clearly communicated before the reservation is confirmed.

Villa SoleLuna reserves the right to change published prices for future reservations. Such changes will not affect already confirmed bookings.

The following cancellation policy applies unless a different written cancellation policy has been expressly agreed for a specific booking.

60 days or more before arrival: The Guest may cancel the reservation and receive a 100% refund of all amounts paid.

59–30 days before arrival: A cancellation fee equal to 50% of the total booking value will apply. Any amount paid in excess of the applicable cancellation fee will be refunded.

29 days or less before arrival: The reservation becomes fully non-refundable. No refund will be due in the event of cancellation, no-show or early departure.

Where a reservation is cancelled within the non-refundable period, Villa SoleLuna may, at its discretion, attempt to rebook the villa for the affected dates.

If the villa is successfully rebooked, Villa SoleLuna may provide the Guest with a partial refund or booking credit corresponding to the amount actually recovered from the replacement reservation, less any applicable costs, commissions, discounts and reasonable administration expenses.

Such a refund or credit is not guaranteed and is entirely dependent on the villa being successfully rebooked.

Requests to change the dates of a reservation must be submitted in writing.

One date change may be permitted, subject to availability and the following conditions: the request is made at least 60 days before the original arrival date; the new dates are available; any difference in the applicable rental rate is paid by the Guest.

A reduction in the rental price resulting from a change of dates does not automatically entitle the Guest to a refund.

Date changes requested within 60 days of arrival may be treated as cancellations and may therefore be subject to the applicable cancellation policy.

Check-in and check-out times will be communicated to the Guest before arrival.

The Guest agrees to provide accurate arrival information and to notify Villa SoleLuna of any significant changes to their expected arrival time.

Early check-in or late check-out may be available upon request but cannot be guaranteed and may incur an additional charge.

All guests may be required to provide valid identification documents as required by applicable Italian law.

Villa SoleLuna may be required to communicate guest information to the relevant Italian authorities in accordance with applicable legislation.

Failure to provide the required identification information may result in the Guest being unable to stay at the property.

The villa may only be occupied by the number of guests stated in the confirmed reservation.

Additional overnight guests are not permitted without prior written approval from Villa SoleLuna.

Any additional guest charges must be paid before the additional guest stays at the property.

Villa SoleLuna reserves the right to refuse accommodation to undisclosed additional guests where occupancy or legal requirements would be exceeded.

Villa SoleLuna is provided for private holiday accommodation and agreed retreat or group activities.

The Guest agrees to use the property responsibly and in accordance with applicable laws and local regulations.

The property may not be used for: illegal activities; commercial activities not agreed in advance; parties or events without prior written approval; activities that may cause excessive noise or disturbance to neighbours; activities that could damage the property or endanger guests.

Any event, celebration, retreat, professional photo shoot or commercial activity must be approved in writing before booking.

Villa SoleLuna is located in a residential and holiday environment.

Guests are expected to respect neighbouring properties and the local community.

Excessive noise, particularly during nighttime hours, is not permitted.

Villa SoleLuna reserves the right to terminate a stay without refund if serious or repeated disturbance is caused by the Guest or their party.

Smoking inside the villa is strictly prohibited.

Smoking may only take place in designated outdoor areas and cigarette butts must be disposed of safely.

Any damage or additional cleaning resulting from smoking inside the property may be charged to the Guest.

Pets are only permitted with prior written approval from Villa SoleLuna.

Where pets are accepted, additional conditions or charges may apply.

The Guest remains fully responsible for any damage, additional cleaning or disturbance caused by their pet.

Children are welcome subject to the suitability of the property and the specific accommodation arrangements.

Guests are responsible for supervising children at all times, particularly around balconies, stairs, terraces, outdoor areas and any swimming or water facilities.

Villa SoleLuna cannot be held responsible for accidents resulting from inadequate supervision or failure to observe safety instructions.

Where a swimming pool or other outdoor facilities are available, guests use these facilities at their own risk and must follow all posted safety instructions.

Children must be supervised by a responsible adult at all times.

The Guest agrees not to engage in behaviour that could create a safety risk to themselves or others.

Villa SoleLuna may require a refundable security deposit before arrival.

The amount and payment method will be communicated to the Guest before the stay.

The security deposit may be used to cover: damage to the property or its contents; loss of keys or access devices; excessive cleaning; missing items; damage caused by smoking; unauthorised additional guests; or other reasonable costs resulting from a breach of these Terms & Conditions.

Any remaining balance will be returned to the Guest after departure and inspection of the property.

The Guest is responsible for any damage, loss or breakage caused by themselves or members of their party during the stay.

Guests must notify Villa SoleLuna as soon as reasonably possible if any damage occurs.

Villa SoleLuna reserves the right to charge the Guest for reasonable repair or replacement costs.

Normal wear and tear will not be charged.

The villa will be professionally cleaned before arrival.

Guests are expected to leave the property in a reasonably tidy condition.

An additional cleaning fee may be charged where exceptional cleaning is required as a result of misuse, excessive dirt, food waste, stains, pet-related cleaning or other avoidable circumstances.

Guests are responsible for keys, access cards, remote controls and other access devices provided to them.

Lost or damaged access devices may incur a replacement charge.

Guests must not provide access devices to unauthorised persons.

Guests are responsible for their own personal belongings during their stay.

Villa SoleLuna cannot be held responsible for loss, theft or damage to personal belongings unless caused by circumstances for which Villa SoleLuna is legally responsible.

Guests should not leave valuable items unattended.

Villa SoleLuna respects the privacy of its guests.

The owner or authorised representatives may nevertheless access the property when reasonably necessary for: emergency situations; maintenance or repairs; safety inspections; addressing serious problems; or fulfilling legal obligations.

Where reasonably possible, the Guest will be informed in advance.

Villa SoleLuna cannot guarantee uninterrupted availability of electricity, water, internet, air conditioning or other services where interruptions are caused by circumstances outside its reasonable control.

Villa SoleLuna will make reasonable efforts to resolve any reported problem as quickly as practicable.

Temporary interruptions caused by local utility providers, weather conditions, infrastructure failures or other external circumstances will not automatically entitle the Guest to a refund.

Villa SoleLuna will not be liable for failure or delay in providing accommodation where this results from circumstances beyond its reasonable control.

Such circumstances may include: natural disasters; severe weather events; fire; government restrictions; war or civil unrest; terrorism; epidemic or pandemic-related restrictions; major infrastructure failures; or other events which make the property unavailable or unsafe.

Where such circumstances occur, Villa SoleLuna will make reasonable efforts to offer an alternative solution, which may include changing the booking dates, issuing a booking credit, or where appropriate, refunding amounts actually recoverable.

Personal circumstances, illness, medical conditions, changes in travel plans, visa issues, flight cancellations or delays do not automatically constitute force majeure events. Guests are strongly advised to obtain appropriate travel insurance covering cancellation, interruption, medical emergencies and travel disruption.

Villa SoleLuna reserves the right to cancel a reservation where circumstances make the property unavailable or unsafe, or where the Guest has materially breached these Terms & Conditions.

If Villa SoleLuna cancels a confirmed reservation for reasons within its responsibility and not due to force majeure, the Guest will receive a refund of amounts paid for the affected accommodation period.

Villa SoleLuna will not be responsible for additional costs incurred by the Guest, including flights, transportation, alternative accommodation or other travel expenses, except where required by applicable law.

Villa SoleLuna may terminate a Guest's stay without refund where there is a serious breach of these Terms & Conditions, including: serious or repeated disturbance; illegal activity; unauthorised events or parties; material damage to the property; deliberate misuse of the property; serious safety violations; or occupancy significantly exceeding the agreed number of guests.

Where appropriate, the Guest may also be responsible for additional costs or damages resulting from the breach.

Villa SoleLuna will take reasonable care to ensure that the property is safe, properly maintained and accurately represented.

To the extent permitted by applicable law, Villa SoleLuna will not be liable for indirect or consequential losses arising from the Guest's stay.

Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

Where Wi-Fi or other internet services are provided, they are offered as an additional convenience and Villa SoleLuna does not guarantee uninterrupted availability or specific connection speeds.

Guests are responsible for their own use of the internet and must not use the service for unlawful activities.

Personal information provided by guests will be processed in accordance with applicable data protection legislation, including the EU General Data Protection Regulation (GDPR).

Guest information may be used for: processing and managing reservations; communicating with guests; complying with legal and administrative obligations; guest registration; accounting and payment purposes; and providing services associated with the reservation.

Personal information will not be sold to third parties. Further details will be provided in the Villa SoleLuna Privacy Policy.

Villa SoleLuna aims to ensure that photographs and descriptions published on its website accurately represent the property.

Minor changes to furnishings, décor, landscaping or equipment may occur over time.

Such minor changes do not constitute grounds for cancellation or refund where they do not materially affect the nature or standard of the accommodation.

Any problem concerning the property should be reported to Villa SoleLuna as soon as possible during the stay.

Guests should give Villa SoleLuna a reasonable opportunity to investigate and, where possible, remedy the problem during the stay.

Complaints raised only after departure may make it difficult or impossible to investigate or remedy the issue.

These Terms & Conditions shall be governed by the applicable laws of Italy, subject to any mandatory consumer protection rights that may apply to the Guest.

Nothing in these Terms & Conditions is intended to deprive a consumer of mandatory rights provided under the laws applicable to their place of residence where such rights cannot legally be excluded.

Any dispute shall, where permitted by applicable law, be submitted to the competent courts in Italy.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

The invalid provision shall be replaced or interpreted, to the extent permitted by law, in a manner that most closely reflects its original purpose.

Villa SoleLuna may update these Terms & Conditions from time to time.

The version applicable to a reservation is the version accepted by the Guest at the time the reservation is confirmed.

By completing a reservation, the Guest confirms that: they have read and understood these Terms & Conditions; they accept the Booking & Cancellation Policy; they are authorised to make the reservation on behalf of all members of their party; the information provided in connection with the reservation is accurate; they agree to ensure that all members of their party comply with these Terms & Conditions.
